1. Acceptance of Terms

By accessing this website or attending The Brave New Earth, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any guidelines or rules posted on-site or online.

2. Event Access & Ticketing

  • Tickets are required for entry and must be purchased through our official ticketing partner (POSH).

  • All sales are final unless otherwise specified.

  • Tickets may not be resold above face value or transferred in violation of POSH policies.

  • Lost or stolen tickets will not be replaced.

  • Entry is subject to venue capacity and security protocols.

3. Programming & Schedule

  • All programming, performances, and activations are subject to change without notice.

  • The Brave New Earth reserves the right to modify event hours, artist lineups, and experience offerings at any time.

  • Delays or changes caused by weather, technical issues, or safety concerns do not qualify for refunds.

4. Health, Safety & Security

  • All attendees must comply with instructions from security personnel, staff, and venue representatives.

  • The Brave New Earth reserves the right to inspect bags, equipment, and personal belongings at entry.

  • Any individual who poses a safety risk, behaves disruptively, or violates event policies may be removed without refund.

  • Attendees participate at their own risk and assume responsibility for their own health and safety.

5. Age Requirements

  • The installation is designed for adults and mature teens.

  • Children under 14 must be accompanied by a parent or guardian.

  • Certain programming—including VIP lounges, evening performances, and partner activations—may be restricted to guests 18+ or 21+.

6. Photography, Filming & Media

  • By attending, you grant The Brave New Earth, PARTNYC, and affiliated partners the right to capture and use your image, likeness, and recorded voice for promotional, archival, and commercial purposes.

  • Personal photography is permitted unless otherwise indicated.

  • Use of professional cameras, drones, stabilizers, or external lighting may require advance approval.

7. Interactive Technologies

Some portions of the experience include AI-driven storytelling, biometric engagement, emotional-tech activations, and other interactive elements. By participating, you acknowledge and agree that:

  • Your interactions may be processed by third-party technologies.

  • Any emotion, voice, or movement-based data collected is used solely to power the experience and not for external marketing.

  • You may opt out of interactive elements by notifying a staff member.

8. Prohibited Conduct

The following actions are strictly prohibited:

  • Harassment, discrimination, or unsafe behavior toward staff or guests.

  • Tampering with equipment, installations, or interactive technology.

  • Unauthorized promotion, solicitation, or distribution of materials.

  • Drugs, weapons, or illegal items of any kind.

Violation may result in immediate removal without refund.

9. Accessibility

The Brave New Earth is committed to creating an inclusive experience.
Guests with disabilities may request accommodations in advance by contacting our team. We will make every reasonable effort to support your needs.

10. Refunds & Cancellations

  • All ticket sales are final unless the event is fully canceled.

  • If the event is postponed, tickets will be honored for the rescheduled dates.

  • Refund disputes must be made directly through POSH under their policies.

11. Weather & Environmental Conditions

As portions of the installation take place outdoors, the event will operate rain or shine unless conditions present a safety risk. Programming adjustments due to weather do not qualify for refunds.

12. Third-Party Partners

The Brave New Earth includes integrations with external partners and technologies (e.g., Billfold, Ovomind, Emotiv, Sora, Tuleste Factory).
We are not responsible for the actions, policies, or performance of third-party vendors or services.

13. Website Content

All text, images, graphics, logos, and materials on this site are the property of The Brave New Earth or its partners and may not be used without written permission.

14. Limitation of Liability

By attending, you waive and release The Brave New Earth, PARTNYC, The Ritz-Carlton South Beach, and all partners from liability for:

  • Injury, loss, or damage to personal property

  • Emotional or sensory effects caused by immersive experiences

  • Interruptions, changes, or cancellations in programming

To the fullest extent permitted by law.

15. Updates to These Terms

We may update these Terms & Conditions at any time. Changes are effective upon posting to this page. Continued use of the website or event participation constitutes acceptance of updated terms.
